Please read thoroughly the present terms of use (“Terms of Use”) before using this mobile application (the “Application”). By accessing this Application or any of its functions, or by using them on any mobile phone, tablet, console or other device (collectively “Devices” and individually “Device”), you acknowledge that you have read these Terms of Use, and you agree to be bound by these Terms of Use as well as all other applicable laws. If you do not agree with these Terms of Use, do not access or use this Application or any of its features.

1. Owner and operator information

1.1. This Application is owned and operated by Slovak Lines Express, a.s., Bottova 7, 811 09 Bratislava, registered in the Business Register of the District Court in Bratislava I, Section Sa, File No. 4722/B, web: www.slovaklines.sk, e-mail: apps@slovaklines.sk (“Slovak Lines”).

1.2. This Application is provided by Slovak Lines in the territory of the Slovak Republic.

1.3. If clear from the context of these Terms of Use, the terms “Slovak Lines”, “we” or “us” shall refer to Slovak Lines for the purposes of these Terms of Use.

2. User restrictions and access

2.1. Keep in mind that using some of the features of this Application requires access to the Internet.

3. Permissible use

3.1. You are authorized to run any part of the Application and:

a) use the Application and its content solely for your personal use.

3.2. You are not authorized to:

a) copy (whether by printing on a paper, storing on a disk, downloading or in any other way), distribute (including distributing copies), transfer, alter or in any way manipulate or otherwise use any material that is contained in the Application;

b) remove notices of copyright, trademarks or other intellectual property notices contained in the original material, from any material copied or printed from the Application;

c) use the Application (or any part thereof) in any unlawful manner, for any unlawful purpose or in any manner inconsistent with these Terms of Use or you shall not act fraudulently or with dishonest intent, such as seek unauthorized access to the program code or insert malware, including viruses or malicious data into this Application or any operating system;

d) use the Application in a manner that could damage, demean, overload, disable or threaten the Slovak Lines’ systems or its security or that could disrupt other users;

e) collect any information or data from the Application or from our systems, or attempt to decrypt transmissions to or from servers running any part of the Application;

f) alter or remove proprietary notices from materials downloaded or printed from the Application;

g) bypass or change security technologies or software of the Application, without the express permission of Slovak Lines;

h) provide the Application in whole or in part free of charge or upon payment to third parties.

3.3. To provide a hyperlink or other link to this Application, send an email to the Slovak Lines web site administrator stating:

a) the URLs of the webpages to link to this Application; and

b) the URLs of the webpages of this Application to be linked to.

3.4. Slovak Lines may, at its sole discretion, accept or reject any request under Article 3.3. Slovak Lines is not obliged to accept any such request or justify any possible rejection in any way.

4. Mobile services

4.1. Using the Application is free of charge, but please note that your operator will charge you applicable prices. The Application contains services and features that are available on certain mobile Devices. Using the Application requires electronic communication through your mobile Device.

5. Security

5.1. If you choose or are provided with a username, password or any other information as part of the Slovak Lines’ security procedures, you shall treat this information as confidential and you must not disclose it to any third party. You shall not allow any unauthorized persons access the Application under your username and/or password. You are responsible for all actions that occur when you use your Application account or use the Application through your Device, and Slovak Lines shall not be responsible for any loss due to the unauthorized use of your username and/or password with or without your knowledge.

6. Intellectual Property Rights

6.1. All intellectual property contained in or in connection with the Application is the property of Slovak Lines or its licensors. All content in the Application including, but not limited to, text, software, scripts, codes, designs, graphics, photos, sounds, music, videos, interactive elements and all other content (“Content”) is the collective work to which the relevant copyright laws apply and it is owned by Slovak Lines. Slovak Lines reserves all rights in respect of the intellectual property rights contained in the Application as well as the Content.

6.2. Specifically, this Application includes trademarks including, but not limited to, the Slovak Lines logo. All trademarks contained in this Application are the property of Slovak Lines or its licensors. Slovak Lines reserves all rights in relation to the trademarks contained in this Application.

6.3. Nothing contained in these Terms of Use may be construed in relation to you as granting a license or intellectual property rights owned by Slovak Lines or its licensors.

7. Privacy Policy

7.1. Slovak Lines defined the purpose of the processing of personal data, determined the conditions of processing and processes personal data on its own behalf as a controller. Identification and contact details of Slovak Lines Express a.s. are listed in Article 1.1 of these Terms of Use.

7.2. The subject of processing is the category of personal information you provide when setting up your account in the Application. Personal data is processed to the extent necessary for the purpose of providing this Application and its functions and in terms of obligations of Slovak Lines under the law.

7.3. For the purposes of direct marketing, personal data is processed if you have granted such processing consent or if Slovak Lines have a legitimate interest that does not override your interests or fundamental rights and freedoms as the data subject. The consent to the processing of personal data may be withdrawn at any time.

7.4. The personal data obtained can then be processed for statistical purposes in a manner compatible with the original purpose of the processing, and Slovak Lines will ensure that personal data is used only to the extent necessary.

7.5. Personal data is processed to an extent necessary with respect to a particular purpose. Providing your personal information marked as mandatory when setting up your account in the Application is a contractual and legal requirement. In the event of failure to provide such data, Slovak Lines shall have the right to refuse to establish an account for you in the Application and refuse to use any of its functions the use of which is tied to the establishment of such an account. Provision of other data is voluntary.

7.6. A processor authorized by Slovak Lines is also authorized to process personal data. The list of processors entrusted with the processing of personal data by Slovak Lines:

Slovak Lines, a.s., with its registered office at Bottova 7, 811 09 Bratislava, company ID (IČO): 35 821 019;

Exponea s.r.o., with its registered office at Twin City B, Mlynské Nivy 12, 821 09 Bratislava, company ID (IČO): 50 017 560.

Slovak Lines also provides personal data, if necessary, to other persons authorized by law.

7.7. Personal data will be retained for the period necessary to exercise the rights and fulfillment of the obligations associated with the provision of this Application and its functions, but at least for the period stipulated by the legislation and registration plan and the Slovak Lines policy. If the legal basis for processing your personal data is your consent, the data will be retained for the duration of the consent.

7.8. As a data subject, you have the right to:

a) obtain information and confirmation as to whether personal data related to you are processed, and you have a right of access to processed personal data,

b) whenever request correction of incorrect personal information,

c) limit the processing of personal data,

d) object to the processing of personal data,

e) file a complaint with the respective supervisory body (e.g. the Office for the Protection of Personal Data of the Slovak Republic),

f) at any time, withdraw consent to the processing of personal data without prejudice to the lawfulness of the consent-based processing without its revocation,

g) transfer personal data to another operator (valid from 25.5.2018),

h) erase data, i.e. the right to forfeit (valid as of 25.5.2018; cannot be applied, if personal data are processed to meet legal obligations, to apply legal claims etc.).

7.9. The provisions of this Article 10 of the Terms of Use apply to you only if you are a natural person.

7.10. The controller processes personal data in accordance with the valid and effective law on the protection of personal data of the Slovak Republic.

8. Disclaimers and liability

8.1. You are responsible for the accuracy of the information you submit or send to the Application. Although Slovak Lines does everything to ensure that all information provided within this Application at the time of their inclusion in the Application is correct, Slovak Lines cannot guarantee the accuracy of this information.

8.2. The Slovak Lines shall, in respect of you in the fullest extent permitted by law, waive any liability whatsoever whether under a contract, a civil offense (including negligence), breach of statutory duty or otherwise, in connection with your use of this Application or as a result of your commitment to the information or advice contained in the Application for:

a) loss of actual or expected profit, revenue, savings, utilization, trade, business opportunity or income,

b) loss caused by interruption of business,

c) loss of reputation or goodwill,

d) loss of or damage to data, information, or software

e) damage caused by changing the terms of the Application, suspending or modifying the Application, loss of data, as well as the cancellation of User access by the Provider or

f) any indirect, special or consequential costs, expenses, losses or damages you have suffered in connection with the use of the Application or the materials published therein, even if such costs, expenses, losses or damages were reasonably foreseeable or you and/or Slovak Lines could have expected them.

9. Websites and apps

9.1. This Application may contain links to other Slovak Lines websites or applications. By clicking on these links, the web site or applications can be displayed in full screen (in this case, you will need to use the Device button to return to this Application), or in some cases may appear within this Application (you will then be able to return to this Application using the navigation buttons within this Application). These links are provided to help you quickly and easily find relevant websites, applications, services and/or products that may be of interest to you. It is up to you to decide whether or not the services and/or products available through one of these websites or applications are suitable for you.

10. Changes and operation of the Application

10.1. Slovak Lines may at any time change the format and content of all parts or any part of this Application including, but not limited to, deleting the features or properties of this Application.

10.2. Slovak Lines shall be entitled to suspend the operation of this Application or any of its features or properties to update the content or for any other reason.

10.3. Occasionally, Application updates can be issued via Appstore or Google Play. Depending on the actual update, the Application or a part of the Application may not be used until you download the latest version of the Application and accept the new terms of use.

11. Transfer of rights

11.1. Slovak Lines shall be entitled to transfer its rights and obligations under these Terms of Use to any Slovak Lines affiliate. No such transfer will affect your rights or the obligations of Slovak Lines under these Terms of Use.

12. Compliant policy

12.1. If you have any questions or complaints about this Application, please contact the administrator of the Slovak Lines website.

13. Severability

13.1. All provisions of these Terms of Use apply independently of others. If the court or other competent authority decides that some of the provisions are unlawful or unenforceable, the remaining provisions will remain in full force and effect.

14. Termination

14.1. Slovak Lines reserves the right, in its sole discretion, to terminate your account and/or access to this Application or any of its functions, remove your profile and any part of your user-generated Content, and/or may at any time limit the use of all parts or any part of the Application for any reason or for no reason, without prior notice and without incurring any liability to you or anyone else. Slovak Lines reserves the right to prevent access to the Application or to any of its features or properties.

14.2. After the termination by any of the procedures specified in Article 14.1, you shall not create a new account with the intent to bypass the termination, removal, or limitation.

14.3. These Terms of Use will remain in effect even after your account and/or your access to the Application expires.

15. Changes to these Terms of Use

15.1. The Company shall be entitled to change these Terms of Use at any time and without prior notice, and the changed Terms of Use will enter into force on the date of their publication in the Application. If Terms of Use change, the next time you run the Application, you will be prompted to express your consent with the revised Terms of Use. For each further use of the Application, the revised Terms of Use will apply.

16. Jurisdiction

16.1. The Terms of Use are governed and construed in accordance with the law applicable in the territory of the Slovak Republic. In the event of any dispute regarding these terms and any disputes related to the Application, a non-exclusive jurisdiction over such disputes shall be held by the courts of the Slovak Republic.

17. Benefit for new registered users in the app

17.1. Slovak Lines has prepared a benefit for each new registered user in this application in the form of one ticket for a discounted fare of €1. The discounted ticket for €1 is valid:

a) for a new registered user in this application (A new registered user is the person who first installs this app or a previous mobile app user who registers under his/her current access data, and for the first time purchases a ticket through this application.)

b) for the logged-in user in this app

c) upon buying any type of ticket (child, youth, adult or senior)

d) only upon the FIRST purchase of an international one-way or return ticket (for a return ticket the benefit only applies to the trip there, the way back is paid in full)

e) to purchase of a discounted ticket for €1, you can purchase only one ticket at your first purchase. For further purchases, the number of ticket purchases is unlimited, with no rebate on any next trip

17.2. Slovak Lines reserves the right to discontinue the benefit at any time at its discretion.
